WHEN A NON-LAWYER ASSAILS SC JUSTICES
SENATE President Vicente "Tito" Sotto III, also a television comedian, was not joking when he assailed all Supreme Court (SC) justices, including their chief, for their en banc decision to overturn a Motion for Reconsideration that it released in July last year. The MR was filed by the House of Representatives.
The matter has to do with the intention of the House members to pursue an impeachment complaint Vice President Sara Duterte.
Sotto, in his reaction, assailed the entire SC, saying it unconstitutionally amended the Constitution. He added that the SC decision is a clear judicial legislation because it introduced a rule for Congress to follow in the conduct of impeachment.
It should be stressed here that the Senate President is not a lawyer, he is not a law professor and that law students and professors are not one with him in his criticism against the SC.
Sotto should remind himself that the SC was only acting as an arbiter or stabilizer in promoting the supremacy of the Consideration.
Chaos or anarchy takes place if each one of us, including non-lawyers, interpret the law according to our personal and emotional stand.
